Cancellation and Returns

Consumers are entitled to the statutory right of withdrawal in accordance with the withdrawal policy. However, customers who act as entrepreneurs or on behalf of a company (according to §14 BGB) do not have a right of withdrawal and return according to §312g BGB in conjunction with §355 BGB. The right of withdrawal applies exclusively to consumers within the meaning of §13 BGB who conclude a legal transaction for purposes that are primarily not attributable to their commercial or independent professional activity.

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

by means of a clear statement (e.g. a letter sent by post, fax or email) about your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.

In case of withdrawal from this contract, we are obliged to refund you all payments you have made to us, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), immediately and no later than fourteen days after receiving your withdrawal. The refund will be made using the same payment method you used for the original transaction, unless expressly agreed otherwise. In any case, you will not be charged any fees for the refund.

We reserve the right to refuse the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You are obliged to return or hand over the goods immediately and in any case no later than fourteen days after receiving your declaration of revocation to Tie Solution GmbH, Returns, Gießener Str. 72, 35415 Pohlheim in Germany. The deadline is deemed to have been met if you dispatch the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods yourself. For goods that are not suitable for parcel shipping, the estimated maximum amount for the costs is set at around 80 EUR.

You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that was not necessary to inspect the nature, characteristics and functioning of the goods.

Exclusion or expiry reasons

The right of withdrawal does not apply to contracts:

for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

for the delivery of imported products, the price of which was agreed upon at the time of conclusion of the contract, but which can only be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their sealing has been removed after delivery;

marked or customized products are excluded from returns.

Your return

Before returning the goods, you must register the returns. Otherwise, a handling fee of see current terms and conditions version of the value of the goods will be charged to you. This also applies to samples!

We only accept returns of unused, unaltered goods.
The delivery must not be longer than 14 days ago.
Write the invoice or delivery note number mentioned in the return application on the return slip.

During the return registration, you have the option to select a return for returns from Germany. In this case, you will receive a return label (DHL / DPD) from us via email, for which €5.95 net will be deducted from the refund amount. (Unfortunately, a return label cannot be created for returns from abroad.) If you choose a different shipping provider, please make sure to select appropriate packaging according to the shipping provider's conditions.
After checking and processing your return, you will receive your credit possibly minus a handling fee via email.

conciliation procedure

On 09.01.2016, the European Commission established a platform for the out-of-court resolution of disputes related to online purchases. It can be accessed via the URL https://ec.europa.eu/consumers/odr. At this point, we would like to inform you that we are not obliged to participate in conciliation procedures and unfortunately cannot offer you this possibility.

severability clause

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid or contain a gap, this shall not affect the validity of the remaining provisions.
